Use of the Website and ������ϱ�Services is subject to these conditions; please read them carefully. By accessing and using the Website, ������ϱ�Services and ������ϱ�Materials (as defined below), you are agreeing to be bound by the terms and conditions of use set out below (“Online Terms of Use”). If you cannot or do not wish to be bound by these Terms of Use, you may not use the Website, ������ϱ�Services or ������ϱ�Materials.

In addition to these Terms of Use, some ������ϱ�Services are subject to additional specific terms, and you agree to access and use the ������ϱ�Services in accordance with these specific terms, as applicable (the “Service Terms”). In the event of any inconsistency between these Terms of Use and the Service Terms, the Service Terms will prevail.

Please ensure that you review these Terms of Use and Service Terms regularly to ensure you remain in compliance. If any part of any term is held to be invalid or otherwise unenforceable, the affected part of the term will be deemed severed and the remainder of the terms will continue in full force and effect.

Acceptable use

In accessing and using the Website, ������ϱ�Services and ������ϱ�Materials, you may not

• Interfere with the proper functioning of the Website or the ������ϱ�Services in any way
• Knowingly transmit, send or upload any material that contains viruses, worms, spyware, adware, Trojan horses or similar computer code that could adversely affect the operation of the Website or its users
• Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity, in association with your use of ������ϱ�Services and/or ������ϱ�Materials
• Share your account or your Means of Access (as defined below) with others 
• Access or attempt to access the accounts or the Means of Access of other users 
• Compromise or attempt to compromise security measures implemented within the Website, ������ϱ�Services or ������ϱ�Materials
• Take any action that imposes an unreasonable or disproportionately large load on the Website
• Take any action involving the Website that will have the effect of facilitating unsolicited bulk email
• Recalculate, reverse engineer or otherwise attempt to reproduce or assist others to reproduce any part of the Website, ������ϱ�Services or ������ϱ�Materials, unless otherwise permitted in writing by CIHI.

Ownership and licensed rights

������ϱ�is the owner of the Website, ������ϱ�Services and the reports, information and other works included in or made available through these (collectively the “������ϱ�Materials”). However, parts of the Website, ������ϱ�Services and ������ϱ�Materials may contain specifications or other intellectual property licensed to ������ϱ�or owned by other organizations, such as the World ������ϱ� Organization and interRAI. 

In addition to the protection afforded by these Terms of Use and any Service Terms, the Website, ������ϱ�Services and ������ϱ�Materials are protected nationally and internationally under intellectual property laws.

Your use of the Website, ������ϱ�Services and ������ϱ�Materials does not grant you any ownership rights to these and you may not do anything more with the Website, ������ϱ�Services and ������ϱ�Materials than as expressly permitted under these Terms of Use and Service Terms.

Use of ������ϱ�Materials

You may freely use and reproduce ������ϱ�Materials for the purposes of education, non-commercial research, internal reference and private study. You are not permitted, however, to make any commercial use of ������ϱ�Materials without CIHI’s express prior written authorization. Additionally, you may not incorporate ������ϱ�Materials into commercial textbooks or into software applications of any kind without CIHI’s express prior written authorization, nor may you use ������ϱ�Materials in any way that could reasonably be seen as competing with CIHI. You may not interfere with anyone else’s access to or use of ������ϱ�Materials, sell ������ϱ�Materials, or substitute or attempt to substitute modified ������ϱ�Materials for the originals on the Website. If you want to use and reproduce ������ϱ�Materials for purposes other than as set out above, including commercial use and use in textbooks, please email copyright@cihi.ca.

You must credit ������ϱ�as the source of any ������ϱ�Materials you use or reproduce in a document or other work that will or may be distributed to others. If those ������ϱ�Materials contain elements ������ϱ�licensed from its licensors, you must likewise credit those licensors. Additionally, you must not remove or conceal any copyright notice or acknowledgement placed by ������ϱ�or its licensors when using or reproducing ������ϱ�Materials.

CIHI’s client services system and applications

Some of CIHI’s Services, such as eStore, Vendor Licensed Product portal and eReporting applications (“Restricted ������ϱ�Services”), are restricted to specific ������ϱ�clients, such as ministries of health and health facilities, as well as to some commercial clients, all of which must meet eligibility requirements.

Clients must set up an account and have a username and password (“Means of Access”) prior to accessing the Restricted ������ϱ�Services. The Means of Access are considered confidential information and 

• May not be disclosed to any person or entity for any reason
• Are non-transferable
• Cannot be issued to an un-named individual or occupational position. 

In addition to requiring an account, these Restricted ������ϱ�Services are governed by Service Terms, and you must agree to these terms before being granted access. You are responsible for all activities done under your account and agree to notify ������ϱ�immediately of any actual or potential unauthorized use of your account, including your Means of Access.

If you already have Means of Access, you can . If you wish to access the Restricted ������ϱ�Services but do not have an account, please email help@cihi.ca to see whether you meet the eligibility requirements and to set up your account.

Modifications to the Website and ������ϱ�Services

������ϱ�reserves the right to make changes to the Website and to the ������ϱ�Services by adding or discontinuing one or more web pages, ������ϱ�Services or ������ϱ�Materials. Unless otherwise set out in the Service Terms, changes to restricted ������ϱ�Services will be communicated to all affected registered clients.

Electronic communications

By using the Website or sending communications from any device to us, you are communicating with us electronically. You consent to ������ϱ�sending you commercial electronic messages, as that term is defined in An Act to Promote the Efficiency and Adaptability of the Canadian Economy by Regulating Certain Activities that Discourage Reliance on Electronic Means of Carrying out Commercial Activities, and to Amend the Canadian Radio-television and Telecommunications Commission Act, the Competition Act, the Personal Information Protection and Electronic Documents Act and the Telecommunications Act, SC 2010, c 23, as modified from time to time.
